TERMS AND CONDITIONS:

Competitions are subject to the privacy policy and website terms and conditions of Fitch Media Limited (“Fitch Media”).

The following rules shall apply, together with any instructions or rules specific to any current competition.

1. By entering the competition you are deemed to have accepted the following and agree to be bound by the competition rules.

2. Fitch Media Limited (“Fitch Media”) reserves the right to cancel or amend the competition, the competition notice or these rules at any time without prior notice. Any changes will be posted either within the Fitch Media website or these rules.

3. Competitions are open to all Fitch Media website users (SkiddMark, SkiddNet and SkiddPlayer), except for Fitch Media employees and their relatives, and anyone professionally connected with the prize offered in this competition. Fitch Media reserves the right to verify the eligibility of entrants and disqualify any entrant. Verification will occur if Fitch Media has reasonable grounds to believe the entrant has breached any of these terms and conditions.

4. By taking part in the competition, you warrant that all information submitted is true, current and complete at the time of submission. It is your sole responsibility to ensure that your details and e-mail address are accurate, and that Fitch Media is informed of any changes to these. Fitch Media accepts no responsibility for any changes which are not properly notified from the time of submission of your entry to the time of notification that the prize has been awarded.

5. In the event of any dispute concerning the rules, notice, conduct, results and all other matters relating to a competition, Fitch Media’s decision is final. Fitch Media will not enter into correspondence or discussion concerning disputes.

6. Entries become the property of Fitch Media. By entering the competition, you thereby assign absolutely the copyright and all other rights in the entry for the full period of the copyright.

7. Prizes are non-transferable and there are no cash alternatives. Fitch Media reserves the right to substitute prizes of equal or greater value at any time. Fitch Media also reserves the right to publish the name and home town or county of the winner in future publications.

8. Only one entry per person per competition is allowed.

9. Competition entries must be made in the manner, and by the closing date, specified.

10. Fitch Media cannot accept responsibility for any error, omission, interruption, deletion, defect and delay in operation or transmission of communications media outside its control. Fitch Media cannot accept responsibility for communications line failure, theft, destruction, alteration of, or unauthorised access to entries outside its control. Fitch Media cannot accept responsibility for entries lost or delayed whether or not arising during operation or transmission as a result of server functions, virus, bugs or other causes outside its control.

11. To qualify for and be entered into any of our competitions, you must answer the specific competition question or questions correctly. Prize winners will be chosen at random from all qualifying Entries within 28 days of the closing date specified in the Competition Notice. Tie-breakers will be judged by Fitch Media and, if required by law, by an independent adjudicator. In all matters, the decision of the judge(s) and Fitch Media shall be final and no correspondence or discussion shall be entered into.

12. All taxes, insurances, transfers and other expenses resulting from the prize are the sole responsibility of the winner unless otherwise stated.

13. Failure to claim a prize within the time or in the manner specified may result in disqualification and the selection of an alternative winner.

14. Prizes are awarded at the discretion of Fitch Media. No prize or prizes will be awarded as a result of improper actions by or on the behalf of any entrant.

15. Fitch Media assumes that by using its site and entering the competition that you have legal capacity to enter the competition and agree to the rules.

16. Any personal information relating to entrants will be used solely in accordance with current UK data protection legislation. It will be not disclosed to a third party without the individual’s prior consent.

17. Fitch Media cannot accept any responsibility for any damage, loss, injury or disappointment suffered by any entrant entering the competition or as a result of accepting any prize.

18. The competition and these rules are governed by English Law. Any disputes arising between the Company and any third party in relation to these Competition Rules and/or a Competition shall be subject to the exclusive jurisdiction of the courts of England and Wales (save that the Company shall be entitled to take action against a third party in any other jurisdiction).
